NOTICE OF INTENT TO MAKE A BYELAW

SEA FISHERIES (BYELAWS) REGULATIONS 1985 – SI NO. 1785 (1985)
In accordance with Section 4 of the above regulations notice SWSFC on Friday 10th February 2006, made the following byelaw  (for consultation):

BYELAW NO:  3 - LOBSTER MINIMUM SIZE.

No person shall take or otherwise remove from any part of a fishery within the South Wales Sea Fisheries Committee District any lobster (Homarus gammarus) of less than 90 mm carapace length. The carapace (body shell) shall be measured parallel to the mid line, from the rear of either eye socket to the distal edge of the carapace. Lobsters of below this size shall be returned immediately to the sea at a position as nearby as is possible from where they were taken.”

Effect of the proposed change?
The byelaw makes no change to the 90 mm measurement and merely clarifies that the way that each lobster is measured is identical to that in National legislation.

NAW have confirmed that a restricted consultation of SWSFC shellfish permit holders and by way of advertisement on our website will meet the requirements of the above regulations.

What you should do?
Any comment should be sent to G Perryman, WAG Fisheries Policy Division, Cathays Park, Cardiff, CF10 3NQ or e-mail : fisheries@wales.gsi.gov.uk   by the 1st August 2006 providing also  a copy to SWSFC.

Yours sincerely
